Terms and Conditions

1. Acceptance of Terms
By creating an account on MIGT SMS, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not register or use the platform. These terms apply to all users, including API clients.
2. Description of Service
MIGT SMS is a cloud-based SMS messaging platform that enables registered users to send individual and bulk SMS messages to recipients, primarily in Ghana. The platform operates on a credit-based billing model. Credits are purchased in advance and consumed as messages are sent — the cost is calculated per SMS segment (1 segment = up to 160 characters; longer messages consume additional segments).
3. Eligibility and Account Registration
- You must be at least 18 years old to create an account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- You may not create more than one personal account or share your account with others.
- You must notify us immediately of any unauthorised access to your account at support@migt.org.
4. Acceptable Use Policy
You agree to use MIGT SMS only for lawful purposes. You must not:
- Send unsolicited bulk messages (spam) to recipients who have not opted in.
- Send messages that are fraudulent, deceptive, abusive, threatening, or defamatory.
- Distribute illegal content, including material that violates Ghanaian law or the laws applicable to your recipients.
- Impersonate any individual, company, or government entity in your sender ID or message content.
- Use the platform to facilitate phishing, malware distribution, or any other cyberattack.
- Attempt to circumvent rate limits, authentication controls, or platform security mechanisms.
- Resell or sublicense access to the platform without our prior written consent.
We reserve the right to suspend or terminate your account immediately, without notice, for any violation of this policy. Suspended accounts are not entitled to a credit refund.
5. Sender ID
Using a custom sender ID requires prior approval from MIGT SMS and must comply with the guidelines of Ghanaian telecommunications regulators (NCA). You must own or have explicit authorisation to use any sender ID you apply for. Approved sender IDs may only be used for the business purpose stated in your application.
6. Credits and Billing
- Credits are prepaid and non-refundable once consumed by a successfully sent message.
- Credits for messages that permanently fail delivery (after all retry attempts) are automatically refunded to your account balance.
- Unused credits do not expire but have no cash value and cannot be withdrawn.
- We reserve the right to adjust credit pricing with 14 days' notice.
- Top-up payments are processed by third-party payment providers. We are not responsible for delays or failures caused by those providers.
7. Data and Privacy
By using MIGT SMS you acknowledge that:
- We collect and process personal data (name, email, phone, message logs) as necessary to provide the service. Message content and delivery logs are stored for up to 12 months.
- You are solely responsible for obtaining any required consent from your message recipients under applicable data protection law, including the Ghana Data Protection Act, 2012 (Act 843).
- We do not sell or share your data with third parties except as required to operate the platform (e.g., SMS gateway providers) or as required by law.
8. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Delivery of SMS messages is subject to the availability and performance of telecommunications networks and third-party providers, which are outside our control. We are not liable for undelivered or delayed messages.
9. Limitation of Liability
To the maximum extent permitted by Ghanaian law, MIGT SMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of revenue, loss of data, or business interruption. Our total aggregate liability shall not exceed the value of credits remaining in your account at the time the claim arises.
10. Termination
You may close your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these terms, are inactive for more than 12 months, or for any other reason at our discretion with reasonable notice where practicable.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
